Compliance with Local Laws: It is your responsibility to ensure your use of GetDates.ai complies fully with all applicable laws, rules, and regulations within your jurisdiction or any jurisdiction from which you access our Service, including but not limited to data privacy laws (such as GDPR), intellectual property laws, consumer protection laws, and laws regarding misrepresentation, deception, or fraud in online interactions (e.g., catfishing or false advertising on dating apps). GetDates.ai makes no representation or warranty that our Service is appropriate or available for use in all locations worldwide. 3. Politically Exposed Persons (PEPs): If you are classified as a politically exposed person (PEP)—meaning you currently hold or have previously held a prominent public position—you are not permitted to use GetDates.ai. By using our Service, you explicitly confirm that you are not a PEP. 4. Identity Verification: We do not require formal identity verification (such as government-issued identification documents) for general use of our Service. However, we reserve the right to request additional verification, including proof of identity, consent, or dating app data (for refund purposes), or to suspend or terminate access if we reasonably suspect a violation of these Terms of Service, misuse, fraud, or potential harm. Failure to comply with any of these eligibility conditions may result in immediate suspension or termination of your account and/or access to GetDates.ai without refund or compensation. You indemnify GetDates.ai against any claims arising from your failure to meet these requirements. 3. User Responsibilities and Prohibited Uses User Responsibilities When uploading or generating content using GetDates.ai, you agree and warrant: • Consent and Permissions: You represent and confirm that you have obtained appropriate consent from all individuals whose images or likenesses you upload or utilize on the Service, and that all uploaded images are of yourself only, without any other persons depicted unless explicit written consent is obtained and retained by you. You acknowledge and accept sole responsibility for verifying and retaining proof of such consent. GetDates.ai does not verify user-uploaded content for consent and expressly disclaims liability in this regard. You must ensure all uploads comply with data protection laws, such as GDPR if applicable. • Age Compliance: You explicitly agree that you will never upload, create, or share content depicting or involving minors under the age of 18, whether explicit or otherwise. Any violation will lead to immediate suspension or termination of your account, reporting to relevant authorities, and potential legal actions. • Self-Representation: All uploaded photos must accurately represent your current appearance, without significant alterations in hairstyle, weight, or other features that could lead to misrepresentation. You are solely responsible for ensuring generated images are used ethically and do not deceive others (e.g., on dating apps). • Indemnification: You agree to indemnify, defend, and hold harmless GetDates.ai, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or liabilities arising from your uploaded or generated content, including but not limited to IP infringement, privacy violations, misrepresentation, fraud, or misuse in dating contexts. Prohibited Uses You expressly agree NOT to use GetDates.ai to: • Inappropriate or Adult Content: Generate, distribute, or otherwise engage with any form of pornographic, explicit, sexually suggestive, nude (beyond optional shirtless as per guidelines), or otherwise inappropriate content. This includes any content that could be deemed harassing or exploitative in a dating context. • Violent, Hateful, or Discriminatory Content: Produce, share, or support content that is violent, hateful, discriminatory, defamatory, harassing, threatening, offensive, abusive, or otherwise harmful in any manner, including content that promotes bias or stereotypes. • Political or Misinformation Activities: Generate or distribute content aimed at spreading misinformation, deceptive or misleading narratives, political propaganda, false claims, or any content intended to manipulate, deceive, or negatively impact individuals, groups, or societies. • Deepfake and Fraudulent Content: Create misleading "deepfake" content intended to deceive, misrepresent, or falsely portray individuals, organizations, or events, including exaggerated alterations to appearance for catfishing or fraudulent dating profiles. Additionally, you agree never to produce falsified documents, impersonations, fake credentials, or otherwise fraudulent or deceptive materials. • Illegal Activities: Participate in, encourage, or promote any form of illegal activities or schemes, including but not limited to fraud, scams, hacking, identity theft, data breaches, or misrepresentation on dating platforms. • Security and System Abuse: Attempt to hack, penetrate, bypass, circumvent, or disrupt security measures of GetDates.ai. You further agree not to engage in scraping, automated access using bots, scripts, excessive resource usage, or other actions that could impair the Service's infrastructure or availability. • Misuse in Dating: Use generated images to misrepresent your age, identity, or appearance in a way that could lead to deception, harassment, or harm on dating apps like Tinder, Bumble, or Hinge. Violation of these terms will result in immediate suspension or termination of your account without notice, potential legal action, reporting to relevant law enforcement or authorities, and forfeiture of any payments or guarantees. GetDates.ai reserves the right to monitor usage for compliance. 4. Intellectual Property, Content Ownership, and Licensing Ownership of Your Content All AI-generated images, content, and other creative outputs you create using GetDates.ai (collectively, "Your Content") remain fully yours. You retain all intellectual property rights and ownership of the content you produce through our Service, subject to the licensing conditions below. License to GetDates.ai By using our Service, you grant GetDates.ai a worldwide, perpetual, irrevocable, royalty-free, nonexclusive, sublicensable license to use, store, process, analyze, reproduce, modify, and adapt Your Content (including uploaded photos) solely for the following purposes: • Providing and operating the Service, including training and improving our AI models (using anonymized or aggregated data only, without identifying you). • Technical support, troubleshooting, and quality assurance. • Compliance with legal obligations, such as responding to authorities. We explicitly confirm that we will not use Your Content for external marketing or promotional purposes without obtaining your explicit prior consent. You acknowledge that AI training may involve Your Content in anonymized form to enhance model accuracy, but we implement measures to prevent re-identification. Public Sharing and Privacy By default, all content you generate or upload remains private and secure within our storage systems. GetDates.ai will not publicly share or distribute your images or creations unless you explicitly decide to share them publicly yourself or as required by law. It is solely your decision and responsibility to share any content externally or publicly, and you bear all risks associated with such sharing (e.g., misuse on dating apps). Intellectual Property and Trademarks You explicitly agree and represent that: • Originality and Permissions: Your Content must be original or used under appropriate license. You must not upload or generate content that violates copyrights, trademarks, or intellectual property rights of third parties, including any training data sourced from public images. You acknowledge that verifying these rights is solely your responsibility. GetDates.ai is not responsible for user-generated content infringement issues and disclaims any liability for AI outputs that may inadvertently resemble protected works. • Use of GetDates.ai's Intellectual Property: All trademarks, logos, brand names, designs, and proprietary materials belonging to GetDates.ai (including our AI models and tools) are protected by applicable intellectual property laws. You must not use, copy, distribute, modify, or reproduce any of GetDates.ai's trademarks or proprietary assets without our explicit written consent. Enforcement and Checks GetDates.ai reserves the right—but is under no obligation—to verify user-generated content for compliance with intellectual property laws, these Terms, or potential misuse. We may perform automated or manual checks, request additional information, or delete content at our discretion. However, this does not relieve users from their primary responsibility to ensure content compliance. 5. Payments, Tiers, and Cancellation Policy Payment Tiers GetDates.ai offers the following options: • FREE to Try: Train your model, generate up to 50 photos with all features, use prompts or pre-sets, with watermark. • Paid ($299 one-time): Same as FREE, plus generate up to 1,000 photos, no watermark, direct support, More Matches GUARANTEED (subject to limitations and verification below), and free Swipestats Membership. All payments are one-time and non-recurring. Access to generated photos and features persists indefinitely, subject to Service availability. Guarantees Disclaimer "More Matches GUARANTEED" is a marketing statement based on user feedback and typical results from optimized photos. It does not constitute a legal warranty or guarantee of specific dating outcomes, which depend on factors beyond our control (e.g., user behavior, profile content, app algorithms, location, and demographics). We disclaim any liability for actual matches, dates, or relationships. No refunds or compensation will be provided based solely on perceived lack of results, except as outlined in the Refund Policy below. Cancellation Policy Since payments are one-time, there are no recurring charges to cancel. You may request account deletion at any time, but this will not entitle you to refunds. Taxes and Additional Fees All fees listed by GetDates.ai exclude applicable taxes, duties, or other governmental charges. You are solely responsible for any applicable taxes or fees required by your local laws or jurisdiction. GetDates.ai may collect taxes where required by law and explicitly stated during checkout; otherwise, responsibility for compliance remains yours. 6. Limitation of Liability and Disclaimer of Warranties Liability Limitation To the fullest extent permitted by applicable law, the total liability of GetDates.ai, its directors, officers, employees, partners, agents, suppliers, or affiliates for any claims arising from or related to your use of the Service is limited to either USD $150 or the total amount you have paid us during the last twelve (12) months, whichever amount is greater. This cap applies to all claims, including those related to generated content, dating outcomes, guarantees, or data breaches. Exclusion of Consequential Damages Under no circumstances will GetDates.ai be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including, but not limited to: • Loss of profits or revenue • Loss of data, goodwill, or business interruption • Costs of procurement of substitute services or products • Other intangible losses, including emotional distress or harms from dating app interactions resulting directly or indirectly from your use of, inability to use, or reliance upon our Service. This limitation applies whether such claims arise under contract, tort, strict liability, negligence, or any other legal theory—even if GetDates.ai has been advised of the possibility of such damages. Disclaimer of Warranties (Service Provided "As-Is") The GetDates.ai Service is provided to you explicitly on an "as-is" and "as available" basis. We expressly disclaim any warranties—express or implied—including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing or usage of trade. We do not guarantee that: • Our Service will meet your specific expectations or requirements, including achieving more matches on dating apps. • Our Service will be uninterrupted, timely, secure, error-free, or always available. • The content or results generated through our Service will be accurate, reliable, error-free, bias-free, or indistinguishable from reality. • Generated images will not infringe third-party rights or lead to any desired outcomes. Content Responsibility Disclaimer GetDates.ai explicitly disclaims responsibility and liability for all content uploaded, created, or shared by users, including any biases in AI outputs or misuse in dating contexts. You acknowledge that all user-generated content is the sole responsibility of the user who creates, uploads, or shares such content. We assume no obligation to review or monitor content proactively, though we may do so for compliance. 7. Dispute Resolution and Legal Individual Claims Only By using GetDates.ai, you agree that any legal claim or dispute between you and GetDates.ai will be handled individually. You waive any right to participate in a class action, class arbitration, or other representative legal proceeding. Time Limit to File Claims You agree that any claim or cause of action you may have related to your use of GetDates.ai must be filed within one (1) year after such claim arose. Otherwise, it will be permanently barred. Governing Law and Jurisdiction These Terms of Service and any disputes arising from or relating to them shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law principles. Any legal action or proceeding must be brought exclusively in the Harju County Court (Harju Maakohus) in Tallinn, Estonia, and you irrevocably submit to the personal jurisdiction of such courts. Notwithstanding this, GetDates.ai may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information. 9. Refund Policy & Money-Back Guarantee We offer a full money-back guarantee for paid users if you do not experience an increase in matches on your dating apps after using our generated photos. To qualify: • You must submit a refund request within 60 days of purchase. • You must provide verifiable dating app data (e.g., screenshots or exports from apps like Tinder, Bumble, or Hinge) showing match statistics before and after using our photos on the same profile, for a reasonable period (at least 30 days of active use). • You warrant that the submitted data is accurate, unaltered, and complete; any falsification will void the guarantee and may lead to account termination. • We will review the data to determine if an increase occurred (defined as any net positive change in matches). Service Availability and Access Duration Disclaimer Disclaimer Commitment to Continued Service At GetDates.ai, we are committed to maintaining and improving the platform over the long term. Our goal is to continuously evolve the service for all our users. We take our responsibility seriously and will make every reasonable effort to ensure the ongoing operation of the service for as long as it is viable to do so. Guaranteed Minimum Access By purchasing the paid tier, you are guaranteed access to the platform and its core features for a minimum period of three (3) months from the date of purchase. During this time, we will work to keep the service running smoothly. Please note that occasional maintenance or short-term technical issues may occur and do not affect this commitment. Unlimited Access Limitations Access to photo generation limits (e.g., 1,000) refers to the operational lifetime of the GetDates.ai platform—not your personal lifetime. While we aim to support the service for many years, we cannot guarantee perpetual availability. In the unlikely event that GetDates.ai must be discontinued (e.g., due to business closure, legal obligations, or other unforeseen circumstances), access to the service may be discontinued. We do not offer refunds or compensation in such cases, unless required by law. Feature and Service Adjustments We reserve the right to change, limit, or remove certain features over time as part of the normal development and improvement of the platform, including updates to AI models or prompts. These changes do not entitle users to refunds, provided the core functionality (photo generation) remains available during the guaranteed minimum access period. 11. Changes to Terms and Contact Information Changes to These Terms We may update these Terms of Service from time to time to reflect changes in our business, technology, legal requirements, or user feedback. • When changes are made, we will update the "Last Updated" date at the top of the document. • In some cases, we may notify you via email or in-app message if the changes are significant. • Your continued use of GetDates.ai after any changes take effect constitutes your acceptance of the updated Terms.
